Vista AI Terms of Service

1. Acceptance of Terms

By accessing or using Vista, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our service. Vista is a product of Nucleus Cloud Corp ("we", "us", or "our").

2. User Accounts

• You must provide accurate and complete information when registering for an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

3. Subscriptions and Payments

• Certain features of Vista require a paid subscription.
• Subscription fees are billed in advance on either a monthly or annual basis.
• Subscriptions automatically renew unless canceled before the renewal date.
• No refunds are provided for partial billing periods or unused portions of subscriptions.
• Prices are subject to change with notice provided prior to billing.

4. Acceptable Use

• You agree to use Vista only for lawful purposes and in accordance with these Terms.
• You may not use Vista to:
  • Violate any applicable laws or regulations
  • Infringe the intellectual property rights of others
  • Transmit harmful code or attempt to gain unauthorized access
  • Engage in activities that disrupt or impair the performance of our service

5. Intellectual Property Rights

• All content, features, and functionality of Vista, including but not limited to text, graphics, logos, and software, are owned by Nucleus Cloud Corp and are protected by intellectual property laws.
• You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit our content without our explicit permission.

6. Third-Party Services

• Vista may integrate with third-party services or applications.
• Your use of such third-party services is subject to their respective terms and privacy policies.
• We are not responsible for the content, privacy practices, or availability of third-party services.

7. Limitation of Liability

To the maximum extent permitted by law, Nucleus Cloud Corp shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Service interruptions, errors, or delays in operation
• Damages resulting from unauthorized access to your account

8. Termination

• We may suspend or terminate your access to Vista at any time for violations of these Terms.
• You may cancel your subscription at any time through your account settings.
• Upon termination, provisions of these Terms that by their nature should survive will remain in effect.

9. Privacy and Data Security

Your use of Vista is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. We implement reasonable security measures but cannot guarantee unauthorized third parties will never be able to defeat those measures.

10. Modifications to Terms

We may modify these Terms at any time by posting the revised version on our website or within the app. Your continued use of Vista after the effective date of any modifications constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by the laws of the state of Delaware, without regard to its conflict of law provisions.
